To lead the Contract Administration Department in all offices within Malaysia (JB, KL, Sarawak and all other states within Malaysia) to support the Technical Sales Department in documents & risks review during Pre-Tender, Post – Tender, Pre-Contract & Post-Contract stages and to also support the Operations Department for post-contract administration matters relating to quantity take off, warranty, contractual disputes, sub-contracting, payment certifications, reporting, retentions and final accounts matters in accordance to the Company Guidelines and Company SOP.
Pre-tender, post-tender, pre-contract and award/contract review support to Technical Sales Department.
Lead and support the Contract QS and Contract Admin on the review, interpretation and advice for of commercial terms and conditions of Tender Documents and LOA/Contract document; on the approach and methodology on re-drafting of contract clauses in Clients & LOA/Contract; governance and enforcement of processes as per company SOP and guidelines; bridge between Technical Sales and Operations during conversion of quote to contract on contractual matters, risk assessment, identify risk levels, propose mitigation plans for acceptance of calculated risks or enforcement of non-acceptance of risks identified.
Post- contract administration
Support Operations Manager on interpretation and advice in LOA/Contract document, variation orders, back-charges, claims and mitigation measures of risk identified; review of WIP projects to ensure completion dates within timeline, support Project Managers on application of EOT notice and letter writings making reference to company rights to support grounds of application; review Performance Board and Warranty as per company guidelines and SOP.
Claims administration for payment claim, certification, retention and final accounts
Lead payment meetings with Operations and Contract Admin team, ensure that performance of KPI are met; enforcement of claims and payment procedures as per company SOP and guidelines; Final account settlement with clients; retention recovery from clients as per timelines in the LOA/Contract.
People/Staff Management Training, coaching and development.
Plan adequate training programme for staff; guide new existing staff in their roles; monitor performance of individual staff to identify gaps and action plans.
Governance and compliance to SOP and company guidelines
Governance of procedures during pre-tender, post-tender, pre-contract and post -contract stages as per company SOP and in the Subsidiary; notification for all reportable and non-compliance issues; monthly/quarterly reporting/updates to Regional Commercial Manager.
Qualifications: A Diploma in Quantity Surveying or Contracts Management with proven practical working experience.
8 to 10 years working experience in construction industry.
Read and interpret contractual terms to understand its complexity and risk implications.
Good letter writing skills for pre and post-contract administration matters.
Good understanding of business processes and interfacing of different roles within the organization.
